A grand jury concluded that the evidence did not warrant charges in the death of an 18-year-old Black man whose body was discovered following a July 4 boating excursion and celebration on an island off the Mississippi Gulf Coast â a determination his family promptly called into question.
The decision, promulgated late Monday by District Attorney Angel Myers McIlrathâwho has presided over the investigation into Nolan Wells' deathâfollows months of fevered conjecture as to how he vanished from the teeming party and why the companions who had conveyed Wells to Horn Island departed without him.
The grand jury, having discerned no evidentiary basis for criminal conduct, concluded thatâin light of multifarious factors, among them the position and condition in which Wellsâ body was discoveredâhis demise was âconsistent with drowning.â
It further observed that post-mortem examinations conducted by the Mississippi medical examinerâs office, as well as by an independent forensic pathologist retained by Wellsâ family, had yielded a determination of undetermined as to both the cause and manner of death.
âShould credible evidence hereafter emerge indicating that Mr. Wellsâ death was not accidental, the matter ought to be laid before the Jackson County Grand Jury for its further deliberation,â the grand juryâs report stated.
According to the report, in the course of its investigation into whether crimes had been committed, the grand jury issued 132 subpoenas and heard from 43 witnesses via direct testimony, sworn statements and recorded interviews.
It weighed evidence, including cellphone data and forensic reports, videos and GPS data.
Attorneys representing Wellsâ family, among them the civil rights lawyer Ben Crump, contended that the grand juryâs report raised more questions than it resolved, and they levelled accusations against the district attorney, asserting that he had concluded the investigation notwithstanding his failure to establish what had occasioned the blunt force trauma to the back of Wellsâ head and body.
They likewise reiterated their entreaty that the U.S. Department of Justice undertake an independent investigation, and exhorted McIlrath to disclose the investigation file together with the medical examinerâs complete autopsy report.
âToday, the State of Mississippi is endeavouring to draw a veil over Nolan Wellsâ death, foreclosing any reckoning with the truth,â Crump said in a statement.
Crump, alongside Wellsâ family and the NAACP, was anticipated to convene a press conference later on Tuesday.
The case has engendered unbridled conjecture and suspicion as individuals contend with Mississippi's legacy of racial strife and the implications of being a Black person within a predominantly white milieu.
Every other member of the cohort that accompanied Wells to the island was white.
At Wellsâs funeral, the Rev. Al Sharpton, in his eulogy, summoned the stateâs racist history, invoking both the lynching of Emmett Till and the assassination of Medgar Evers.
âMississippiâs history imparts, with excruciating poignancy, precisely why families ought never to be consigned to merely countenancing unanswered questions attending the demise of a young Black person,â Sharpton said in a statement Tuesday.
âTransparency and accountability are of consequence.
The truth is of consequence.
Nolanâs life was of consequence.â
In a 15-minute video disseminated via social media on Monday, McIlrath articulated her exasperation regarding the imprecise conjecture proffered by certain segments of the public concerning the circumstances surrounding Wells' fate.
She further disclosed that legal representatives for Wells' family had apprised her office the preceding month that their independent inquiry had unearthed no evidentiary basis for criminal conduct.
"What I cannot countenance, what I cannot overlook, is that spurious narratives â that Nolan's death was in some measure racially motivated, and that this constitutes yet another instance of a young Black man denied justice by a racist, corrupt system â were propagated and permitted to proliferate.
Not a scintilla of evidence exists to substantiate these narratives," she said.
Counsel for three of Wellsâ associatesâindividuals who have found themselves the target of pervasive, evidentially unsupported online speculation alleging their complicity in his demiseâcharacterized the grand juryâs findings as a considerable alleviation of their clientsâ burden.
âHe said that he felt as though he could breathe for the first time,â attorney Tyler Cox said of one of Wellsâ friends.
âThis does not bring Nolan back in any way whatsoever, but this can at least set them upon a path where they can at last mourn Nolan, now that they have been officially exonerated of any wrongdoing.â
Wells vanished amid Fourth of July festivities with friends on Horn Island.
His body was recovered at the islandâs northwestern extremity two days after his last confirmed sighting.
Scarcely had Wells been discovered deceased when Jackson County sheriffâs officials intimated that investigators entertained no suspicion of foul playâan announcement that ignited pervasive apprehensions as to whether law enforcement would undertake a rigorous investigation in a state bearing a savage legacy of racism and civil rights violations.
McIlrath time and again pledged a fair and exhaustive investigation into his death.
Wellsâ parents, together with their lawyers, gave voice to suspicions after Wellsâ friends departed the island without him, contending that he had wished to remain behind and converse with a girl.
Wellsâ phone had been aboard the boat that conveyed him to the island, a vessel that was subsequently towed partway back toward the mainland after it began taking on water.
Crump and Wellsâ parents have cast doubt upon why a teenager would elect to remain on an island bereft of his phone.
They further speculated that messages on his phone had been tampered with and alleged that his friends were reluctant to surrender his phone and keys.
Lawyers for Wellsâ friends said the friends are cooperating with authorities.
The grand jury stated that it had been furnished with a report from Crumpâs experts concerning the contents of Wellsâ phone.
Although the specific contents were not delineated in the grand juryâs redacted report, the panel observed that Crumpâs team had not disclosed anything indicative of criminal actions connected to Nolanâs death.
The grand jury report observed that it was neither anomalous nor suspicious for individuals to depart the island aboard vessels other than those by which they had arrived.
It further noted that Wellsâ phone was not the sole device to have journeyed back to the mainland bereft of its owner that day.
A witness testified before the grand jury that he had observed Wells slip clumsily from the side of a boat at approximately 3:30 p.m. on July 4, yet that Wells continued to socialize following the fall and exhibited no apparent signs of injury, according to the report.
The panel stated that it was unable to ascertain whether the fall had occasioned the bruising upon Wellsâ body.
An independent autopsy commissioned by Wellsâ family concluded that Wells had sustained apparent blunt force injuries to his head and body prior to his death, yet the origin of those injuries remains shrouded in mystery.
That report further noted that, while alcohol was detected in Wellsâ body, the finding was profoundly unreliable, inasmuch as the testing entailed decompositional fluid.
Such fluid, examined post mortem, may encompass alcohol imbibed during life as well as ethanol generated after death through microbial fermentation, it stated.
The grand jury's report culminated in the panel tendering its condolences to Wells' family.
"The evidence received in this matter convinced the Grand Jury of Mr. Wells' outstanding character," it stated.
