On Friday, a Texas appellate court slashed a $50 million judgment against Alex Jones, the founder of Infowars, to $1.5 million, a ruling that pertained to his fraudulent assertion that the 2012 Sandy Hook Elementary School massacre was a fabricated hoax.
This reduction does not impinge upon the $1.25 billion judgment levied against Jones in Connecticut, yet it constitutes a juridical triumph for him and his enterprise, Free Speech Systems, subsequent to their being held liable for damages arising from their promulgation of the claim that the shooting never transpired.
Notwithstanding the multiplicity of pecuniary sanctions imposed in both Connecticut and Texas, Jones has remitted no payment, as he continues to pursue appellate remedies and endeavors to liquidate his corporate assets.
The unanimous opinion rendered by the Texas Third Court of Appeals articulated that Neil Heslin and Scarlett Lewis, the parents of a Sandy Hook victim, failed to adduce evidence demonstrating that the harassment incited by Jones's fabricated allegations attained a magnitude sufficient to transcend the $750,000 statutory cap on damages applicable to each plaintiff in the state.
The appellate tribunal determined that the trial court judge had improperly permitted the parents to seek damages exceeding that statutory ceiling.
Heslin and Lewis's six-year-old son, Jesse Lewis, numbered among the twenty children and six educators slain during the assault in Newtown, Connecticut.
This litigation and the 2022 verdict marked the inaugural instance in which Jones faced monetary liability for propagating mendacious claims regarding the massacre, which he contended was a governmental contrivance designed to fortify gun control measures.
Although Jones characterized the lawsuit as an assault upon his First Amendment prerogatives, he conceded during the proceedings that the attack was "100% real" and that his dissemination of falsehoods concerning it constituted an error.
Nevertheless, during his streaming broadcast on Friday, he heralded the Texas ruling as a "massive victory for the First Amendment" and affirmed his intention to petition the state's supreme court for the dismissal of the remaining damages.
"I have exceptional constitutional attorneys, and they will not relent," Jones declared.
Mark Bankston, counsel for Heslin and Lewis in Texas, dismissed the appellate decision as "irrelevant" given that Jones continues to confront substantial financial judgments.
"The family is utterly unconcerned with this inconsequential ruling, which affects merely two of the nineteen claims they share.
Jones remains liable for over a billion dollars, so this alters nothing whatsoever.
It merely underscores the absurdity of Texas law," Bankston remarked.
Heslin and Lewis had apprised the jury that an apology would prove insufficient, imploring them to compel Jones to compensate for the years of anguish endured by themselves and other Sandy Hook families.
During the Texas and Connecticut trials, relatives of the victims testified that adherents of Jones, credulous of his assertions that the shooting never occurred, subjected them to threats of homicide and sexual violence, in-person harassment, and vitriolic commentary on social media.
Jones contended that no evidence linked him to those actions.
Andino Reynal, Jones's trial attorney, had previously stated that he anticipated Jones would appeal the damages award immediately following the verdict and secure a reduction to $1.5 million.
Jones and his company have filed for bankruptcy, and those proceedings remain ongoing.
The satirical publication The Onion has also moved to assume control of Jones's Infowars platform, transforming his megaphone for conspiracy theories into a parody site.
Jones abandoned the Infowars brand in April, relocating to new premises, transitioning his show to a novel website, and posting on his personal X account.
Meanwhile, The Onion has established its own Infowars web page on its site, featuring videos of a parody show lampooning Jones.
Christopher Mattei, counsel for the Sandy Hook families in the Connecticut litigation, stated that Friday's ruling would not affect the ongoing lower-court proceedings in Texas, including the liquidation of Infowars' parent company.
