At the end of this month, the Supreme Court will decide whether to hear an appeal by a lobster fisherman against the government requirement that boats use electronic tracking devices.

That case could have far-reaching consequences for the American commercial fishing industry.

Frank Thompson, a Maine lobster fisherman, filed a federal lawsuit against the head of his state's marine resources department over a requirement to install a GPS tracker on his boat in order to keep his fishing license.

In 2023, the state, where lobster fishing is an industry as critical as it is historic, required all lobstermen with a federal permit to do so in order to comply with a new U.S. rule aimed at data collection.

Thompson maintained that the monitoring amounted to an unreasonable search and seizure, although a federal appeals court dismissed his claim last year.

He then appealed to the Supreme Court, which is scheduled to review the claim on September 28.

"The petition raises the question of whether Maine can force lobstermen to carry government GPS trackers on their private boats, even when they are not working," said Matt Gilliam, Thompson's lead attorney.

"We hope the court will grant review and address this important Fourth Amendment issue."

Numerous American commercial fishermen are monitored on the high seas by human observers and electronic devices in order to collect data that, in the regulators' view, is crucial to keeping both the industry and fish populations sustainable and healthy.

Over the years, fishing associations have turned to the courts to try to limit monitoring requirements, with mixed results.

Authorities have indicated that the monitoring program for lobster boats is important for improving understanding of the valuable crustacean population at a time when it appears to be declining in New England.

A spokesperson for the Maine Department of Marine Resources declined to comment on Monday.

Carl Wilson, the department's commissioner, stated last year that the data provided by lobster boats are essential for "mitigating the economic harm to the industry," as well as for informing the development of regulations.

Conservation groups have opposed efforts to reduce monitoring of fishing vessels at sea, which they consider important for protecting the ocean as a whole.

Efforts to overturn a ruling by a federal appeals court do not change the fact that the New England lobster population has declined and that fisheries managers urgently need reliable, detailed data to respond to the complex problems facing our ocean," said Erica Fuller, senior attorney at the Conservation Law Foundation.

The U.S. lobster industry is concentrated mainly in Maine, where fishermen caught more than 78 million pounds (35.4 million kilograms) of these crustaceans last year.

That figure was similar to the industry's typical annual catch in the 2000s, but it represents a marked decline compared with a decade ago, when catches habitually exceeded 120 million pounds (54.4 million kilograms) a year.
