President Donald Trump’s administration beseeched the Supreme Court on Thursday to once more pave the way for the continued expedited deportation of immigrants to third countries with which they have no ties.
The government petitioned for an immediate suspension of lower court orders holding that individuals must be afforded the opportunity to lodge objections prior to their deportation by the U.S. government to countries other than their homelands.
The justices had previously sanctioned the provisional continuation of the deportation flights when the matter first came before them last year.
In the intervening period, an appellate court has affirmed a Boston-based jurist's conclusive ruling that migrants must be afforded a meaningful opportunity to contend that a third-country deportation would expose them to persecution or torture.
The ruling did not categorically proscribe such deportations; it merely protracted the procedure.
The government contends that it has already occasioned the cancellation of a flight bound for three different countries, carrying 70 individuals with criminal convictions.
"The government has, in recent months, succeeded in effecting the removal of thousands of aliens to third countries, and thousands more remain eligible for such removal," Solicitor General D. John Sauer wrote.
Trump’s Republican administration has asserted that it dispatches individuals to third countries when it is unable to expeditiously repatriate them to their homelands.
Those third-country governments furnish assurances that such individuals will not be subjected to persecution or torture, attorneys said.
The legal stipulations imposed by the lower courts, attorneys contended, would precipitate a cascade of delays and could compel the renegotiation of accords with foreign nations.
James Percival, the Department of Homeland Security’s general counsel, averred on Wednesday via X that 25,000 individuals residing in the United States unlawfully had been deported to third countries, characterizing those deportations as “an essential public safety tool.”

The overwhelming preponderance of deportees has been consigned to Mexico; yet, pursuant to a succession of frequently clandestine accords, the administration has expelled thousands more to upward of two dozen nations, ranging from Liberia to Guyana.
Certain individuals have found themselves marooned in nations of which they had been wholly oblivious prior to their arrival.
Others, moreover, confront grave threats to their safety, leaving them with scant alternative but to return to the very homelands from which they were fleeing.
This month, lawyers representing two men deported to Equatorial Guinea alleged that their clients were beaten and held at gunpoint by police officers—who had shrouded their heads in bags—within a hotel repurposed as a detention facility.
In his tweet, Percival embedded a video depicting Taylor Swift beaming and gesturing toward her wedding ring as she commemorated a touchdown scored by her husband, the football player Travis Kelce.
"Were I to apprise my wife that we have deported 25,000 illegal aliens to third nations, you should behold the manner in which she regards me," Percival wrote.
The case unfolds against the backdrop of a sweeping immigration crackdown orchestrated by the Trump administration, which has vowed to deport millions of individuals residing in the United States unlawfully.
