A man from Venezuela was shot by a U.S. ICE officer.

His lawyer said he went back to the hospital on Monday night.

His name is Wilber Rafael Garces Perez.

He is 28 years old.

He went to a Texas detention center.

A bullet is still in his back.

Perez was working for DoorDash in Austin on Sunday.

He was making a delivery.

Then ICE officers in a truck hit his car two times.

His lawyer is Kate Lincoln-Goldfinch.

She said the officers hit his car.

She said they shot him in the back of the neck.

He tried to park his car.

He got help at a hospital.

Then he went into ICE custody on Sunday.

The bullet was still inside him.

Perez spoke by phone on Monday.

He said doctors did not take out the bullet.

The bullet is near his spine.

He said ICE wanted him out fast.

ICE wanted to move him to a detention center.

He said he got no pain medicine there.

He slept on the floor.

Then a nurse gave him a pill.

Lincoln-Goldfinch said Perez was held at the South Texas ICE Processing Center.

It is in Pearsall.

Pearsall is about 130 miles southwest of Austin.

She said he told her he was being questioned.

The Department of Homeland Security said it is looking into the shooting.

The man is from Venezuela.

He is in the U.S. illegally.

He had a final order of removal.

The department did not say why the shooting happened.

Lincoln-Goldfinch said Perez came to the U.S. legally in 2024.

He came through the CBP One program.

He had a valid work permit.

She said a judge ordered his deportation.

He missed a hearing.

The notice went to an old address.

U.S. Rep. Greg Casar said the hospital return is a good first step.

Local advocates and Democratic lawmakers want an independent review.

They want to review ICE use-of-force incidents.

They urged Congress to ban ICE traffic stops.
