As part of a deal with the Department of Justice, at least six major hospitals have agreed to refuse to provide gender-affirming hormone therapy and surgery to transgender youths, in exchange for making payments to the federal government.

It was only last week that the latest agreement was concluded.

The majority of hospitals had already ceased providing the treatment, owing either to prohibitory orders issued by state governments or to pressure previously exerted by Donald Trump's administration.

Under the agreement with the Department of Justice, the investigation into care previously provided is concluded, and the possibility of hospitals being compelled to submit patient records is also halted.

The Department of Justice states that it has also agreed to assist certain providers in covering the medical costs of children's "detransition."

The hospital has not yet gone so far as to acknowledge that any negligence occurred.

"It sets a truly dangerous precedent when the federal government is permitted to politicize care for a particular, arbitrary group and then abolish it," said Eliel Cruz, a co-founder of the Gender Liberation Movement.

The following is an overview of the situation:

Last week, the Department of Justice announced settlements reached with NYU Langone Hospital and the University of Pittsburgh Medical Center.

Both hospitals agreed not to provide puberty blockers, hormone therapies, and gender-affirming surgeries—which the administration terms "gender-denying procedures"—to patients under the age of 19.

"The Department of Justice is fighting to protect our nation's children and is working to reach agreements with hospitals in order to put an end to so-called 'gender-affirming care' for minors," U.S. Attorney General Todd Blanche declared in a statement last week.

NYU agreed to pay the federal government $8.5 million, and UPMC agreed to pay $950,000.

These settlements follow a series of similar agreements reached since May with the Cleveland Clinic, Connecticut Children's Hospital, New York's Mount Sinai Health System, and Texas Children's Hospital.

The hospitals maintain that these transactions will have no bearing whatsoever on how transgender children are treated within their pediatric mental health programs.

Last year, the Trump administration published a review that encouraged minors to pursue therapy alone rather than more comprehensive gender-affirming care.

Nevertheless, the vast majority of major medical organizations, including the American Medical Association and the American Academy of Pediatrics, support maintaining access to such treatment.

Mount Sinai is the only one of the six institutions that have so far reached a deal not to have previously made its decision public.

Hospitals in Texas and Ohio had already ceased providing care under state bans.

Other hospitals had announced policy changes ever since Trump resumed office in January 2025 and embarked on a series of measures targeting such care.

In January 2025, he signed an executive order curtailing federal support for gender transition procedures for those under 19, and his administration prohibited federal Medicaid funds from covering the treatment.

This care remains available through a remarkably diverse array of hospitals, clinics, and individual practitioners.

As part of a pivotal measure undertaken by the administration, subpoenas were dispatched to hospitals and first made public in July 2025, demanding the provision of information concerning gender-affirming care for children—that is, information including patients' names.

In a statement, NYU Langone said that agreeing to the settlement would serve to protect its patients and their families.

That is because it eliminates "the threat that NYU Langone would be compelled to provide the confidential information it had previously been ordered to disclose concerning patients under the age of 18 who had received gender-affirming care at the institution."

Several hospitals petitioned the courts in order to prevent being compelled to produce records, and the majority of them prevailed in the district courts.

Nevertheless, the ruling handed down by the appellate court last month served to corroborate the government's contention.

In a 2-1 ruling, the U.S. Court of Appeals for the Ninth Circuit, which is based in San Francisco, held that the administration's objective of putting an end to gender-affirming care for young people is not illegitimate, and that it cannot be invoked as grounds for suspending the effect of the subpoena.

In at least 27 states, laws have been enacted that either restrict or outright prohibit gender-affirming care for minors.

Moreover, since last year more than 24 hospitals, health systems, and clinics in states where no bans have been enacted have ceased providing such care, including some situated in states where specific legal protections exist.

A group of Democratic state officials has filed suit against the Trump administration, contending that its efforts amount to nothing less than unlawful intimidation of health care providers.

Although gender-affirming surgery for those under 18 is rare, many transgender youths are receiving hormone therapy in order to halt puberty or to promote the development of sex-related characteristics consistent with their gender identity.

Cruz's Gender Liberation Movement staged protests against hospitals that had discontinued care.

According to Cruz, while some families relocated to other states in pursuit of access to treatment, they found themselves confronted with providers in their new locations halting such treatment.

He further stated that some had even left the country.

He stated that agreement with the Trump administration is laying bare "who possesses the courage to fulfill what their calling and their education impose upon them—namely, to do no harm—and who does not."

This article has been updated to clarify that the agreement requires hospitals to make payments to the federal government, and does not call for payments to the government in order to overturn the transition.
