A federal judge in Missouri on Tuesday issued a temporary injunction barring the state from employing its antiquated congressional districts in the November election, following the U.S. Supreme Court's refusal to intervene in the convoluted and labyrinthine legal dispute.

The rulings underscore the labyrinthine intricacy of Missouri’s redistricting imbroglio, a protracted impasse that has now persisted for upwards of a year.

The federal court action materialized mere days after the Missouri Supreme Court ruled that the state is precluded from employing a newly delineated U.S. House map, endorsed by President Donald Trump, in the forthcoming November election, owing to the fact that citizens had submitted thousands of petition signatures demanding a statewide referendum on the matter.

On Tuesday, the Supreme Court of the United States declined to entertain an appeal lodged by Missouri’s Republican attorney general, thereby allowing the injunction issued by Missouri’s highest judicial body to stand.

Yet, within moments, U.S. District Judge Stephen Clark issued a temporary restraining order precluding Missouri from employing any configuration other than the newly delineated districts favored by Republicans.

The newly delineated districts were deployed for the August primary, and the victorious candidates have already received certification from election officials.

The protracted uncertainty over which district boundaries will govern the November election remains an unresolved point of contention.

The Supreme Court on Tuesday rebuffed an appeal from Missouri officials who sought to employ newly delineated congressional districts endorsed by President Donald Trump in the November election—a setback for Republicans who had harbored aspirations that the revised map might enable them to preserve their precarious majority in the House.

The justices declined to disturb a ruling by Missouri’s highest court, which held that the newly drawn districts had been automatically suspended by a citizen-initiated petition demanding a statewide referendum.

This ruling constitutes a singularly notable reversal for the Republican Party within a nationwide redistricting campaign that Trump exhorted his party to initiate the previous year.

Missouri’s newly delineated districts were deployed in the August primaries; however, in September, the Missouri Supreme Court ruled that the state must revert to the districts adopted subsequent to the most recent census.

Republican state Attorney General Catherine Hanaway, who lodged the appeal, had contended that permitting voters to switch districts between the primary and general elections would contravene federal rights, further asserting that such a change would engender widespread confusion.

Missouri is currently represented in the United States House of Representatives by a delegation comprising six Republicans and two Democrats, each of whom secured their seats under congressional district boundaries that were ratified by Republican state officials in 2022.

At Trump's behest, Missouri Governor Mike Kehoe convened a special legislative session last year to redraw congressional boundaries in their favor, strategically positioning themselves ahead of the midterm elections.

The meticulously redrawn map was strategically engineered to target the 5th Congressional District, a bastion of Democratic incumbency long held by Emanuel Cleaver of Kansas City.

It deftly excised substantial swaths of Kansas City, redistributing them into two adjacent Republican-held districts, while simultaneously extending the residual expanse of Cleaver's constituency far eastward, deep into the rural Republican heartland.

Cleaver sailed through the Democratic primary unopposed, while State Senator Rick Brattin clinched the Republican nomination in the redrawn district, a testament to the shifting political landscape.

Coinciding with the primary election, Republican Secretary of State Denny Hoskins repudiated a petition bearing thousands of signatures that sought to compel a November referendum on the redistricting map.

Hoskins contended that Missouri’s Constitution precludes any referendum pertaining to congressional redistricting.

Although a lower tribunal concurred with this interpretation, the state Supreme Court subsequently overturned Hoskins’ ruling.

The state’s highest judicial authority determined that the newly delineated districts had been rendered retroactively inoperative as of December, the moment at which the petition signatures were tendered, and consequently never attained the force of law.

Hoskins, on Tuesday, designated the redistricting referendum as Proposition A on the November ballot, thereby effectuating compliance with the mandate issued by the state tribunal.

The Missouri Constitution does not explicitly stipulate that a referendum may be invoked for congressional redistricting; nevertheless, the state Supreme Court has determined that a constitutional clause permitting referenda on “any act” of the Legislature encompasses legislation pertaining to congressional redistricting.

Missouri was the second Republican-led state, after Texas, to heed Trump’s call last year to redraw congressional districts, with several other states subsequently following suit.

In aggregate, Republicans had aspired to secure as many as 16 additional seats from the newly enacted House maps across eight states — Texas, Missouri, North Carolina, Ohio, Florida, Tennessee, Louisiana and Alabama.

Democrats, whose counteroffensive encountered numerous impediments, contend that they might gain up to six additional seats from the redrawn districts in California and Utah.

Whether the redistricting will ultimately redound to the Republicans' anticipated advantage remains a moot point.

Historically, the president's party has been compelled to cede congressional ground during midterm contests, and Trump's abysmal approval ratings could well constitute an insurmountable obstacle for Republican aspirants.
