A three-judge panel of a federal appeals court on Thursday weighed a bid to reinstate Missouri's new congressional districts, which President Donald Trump had backed, even though the U.S. Supreme Court has barred those districts from being used in the November election.

A three-judge panel of the U.S. Court of Appeals for the Eighth Circuit heard arguments in the protracted dispute over whether the state should retain the new congressional district map that Republicans drew for the August primary.

Yet even if the panel were to rule in favor of the new map, its effect would remain uncertain, inasmuch as the U.S. Supreme Court had earlier stayed the lower court's order upholding the map, pending a possible appeal and the Supreme Court's final determination.

In light of prior rulings by both the Missouri Supreme Court and the United States Supreme Court, Missouri now intends to retain, for the November election, the same congressional districts as those used in 2024 and 2022.

In court filings, local election officials stated that they had already begun printing ballots featuring the aforementioned districts, and that under federal law they were obliged to dispatch absentee ballots to overseas citizens and military voters by the Friday deadline, whereas state law required that absentee ballots be made available to all other voters by the following Tuesday.

According to a filing submitted by the Missouri Association of County Clerks and Election Authorities, attempting to change the districts at such a late stage would be "practically impossible" and would inevitably cost hundreds of thousands of dollars.

Lawyers representing Republican U.S. Representative Bob Onder and state Senator Rick Brattinthe latter also the Republican nominee for a certain congressional districtargued before the appellate court judges that there is still ample time to reinstate the map backed by Trump.

Just as he had argued at the district court level, Missouri Deputy Solicitor General Lou Capozzi urged the appellate panel to hold that the United States Constitution prohibits a referendum petition from suspending a congressional map passed by legislators before a statewide vote is heldeven though the Missouri Supreme Court has already ruled that the state constitution requires precisely that.

The appellate court judges declared that they would render a ruling expeditiously, noting that any decision they reached would likely be subject to appeal to the United States Supreme Court.

"We will inevitably have to render a decision first, and then they too will have to render a decision, and ultimately the poor election officials will still have to pick up all the pieces," said Judge James Loken, who was appointed by former President George H. W. Bush.

Loken interrogated the lawyer for the organization "People Not Politicians"which had been gathering petition signatures in an effort to force a statewide referendum on the new district map endorsed by Trumpwith incisive ferocity.

When the lawyer, Chuck Hatfield, argued that it was already too late for the appellate panel to attempt to alter the election at this juncture, Loken finally cut him off with impatience and declared flatly: "You're out of time, for goodness' sake!"

The two other members of the panelJudges David Stras and Justin Smithwere both appointed by Trump.

Before his appointment in June, Smith had been a practicing attorney, and in litigation brought by the writer E. Jean Carroll, he represented Trump in an appeal to the U.S. Supreme Court concerning a $5 million jury verdict, though the effort ultimately came to nothing.

Among the roughly dozen states that have sought to redraw their U.S. House districts over the past year, Missouri's redistricting battle stands out as by far the most protracted, convoluted, and baffling case.

Trump has driven this extraordinary wave of midterm redistricting, pressing Republican-dominated states to redraw their maps in hopes of seizing an early advantage in the midterm elections that will determine control of Congress and shape its agenda.

In September of last year, the Missouri legislature approved a redrawn congressional map, a move that effectively reconfigured the Kansas City district represented by Democratic Representative Emanuel Cleaver.

Brattin emerged victorious in the Republican primary and will consequently mount a challenge against Cleaver.

Republicans harbor the hope that this map will enable them to capture seven of the state's eight House seatsone more than they currently hold.

In December, however, opponents submitted thousands of petition signatures in an effort to force a statewide vote on the new districts.

It was not until Augustthe very day the primary was held under the new districtsthat Republican Secretary of State Denny Hoskins rejected the petition, asserting that referendum petitions do not apply to congressional redistricting.

In September, the Missouri Supreme Court overturned Hoskins's ruling, holding that the new map could not be used until it was put to a November referendum for voters to decide whether to retain or reject it; the court further stated that the state must instead adopt the redistricting plan approved in 2022.

However, the matter did not die down there.

A federal judge in St. Louis subsequently issued a self-contradictory injunction barring the adoption of any redistricting plan other than the new map backed by Trump.

The judge noted that changing district lines between a primary and a general election might constitute an infringement of federal rights.

The U.S. Supreme Court stayed the judge's injunction last week, but the Eighth Circuit Court of Appeals nonetheless proceeded to hear arguments in the case on Thursday.
