A judge in Utah will decide on Tuesday.

He will decide if Tyler Robinson goes to court for killing Charlie Kirk.

This is called aggravated murder.

If he goes to court, Robinson could get the death penalty.

Prosecutors showed evidence in July.

They showed it for five days.

They called the evidence "overwhelming."

Robinson is 23 years old.

Robinson gave himself to police.

He did this one day after the shooting.

The shooting was at Utah Valley University last September.

He has not said if he is guilty or not guilty.

His lawyers want to stop the trial.

They also want to remove the death penalty.

There was heavy security at the courthouse in Provo.

Kirk's parents came together.

They held arms.

The judge could send the case to court on a lesser murder charge.

That charge means 15 years to life in prison.

He could also drop the charges.

Then prosecutors could file them again.

One big question is if the shooting put other people in danger.

Defense lawyers said the shooter "hit the intended target."

Prosecutors said many people were in a "zone of danger" around Kirk.

Prosecutors also say Robinson chose Kirk because of his political beliefs.

They show a bullet with words on it.

The words say "Hey Facist! CATCH!"

They also show a note.

The note says, "I had the opportunity to take out Charlie Kirk, and I took it."

Robinson's lawyers say the political reason is weak.

They also question DNA tests.

The tests link Robinson to the rifle.

The judge will say his decision from the bench on Tuesday.
