On Monday, the Supreme Court said the government can quickly send some migrants to other countries. Before, migrants could try to stop this, but now they cannot.
The main court did not explain their decision in the short document. Justice Sonia Sotomayor and two other judges strongly disagreed with it.
Tricia McLaughlin, a spokeswoman for the Department of Homeland Security, said that they might soon start sending people who are not from the US to other countries. She said, "Get the planes ready to send people away," and called this decision "a win for the safety of people in America."
But a judge said one flight that was going to South Sudan would not leave right away.
The people on the May flight were from countries like Myanmar, Vietnam, and Cuba. They had done serious crimes in the U.S. and were found guilty. Immigration workers said they could not send them back to their home countries fast.
Their lawyer, Trina Realmuto, said they might be put in prison, hurt, or even killed if they are sent to South Sudan. She is the head of the National Immigration Litigation Alliance.
A judge in Boston said that the immigrants can still talk about their problems in court. They were sent to a navy base in Djibouti.
This case is happening because President Donald Trump's government wants to send away many people who are living in the United States without permission.
Abigail Jackson, who speaks for the White House, said the President can make sure immigration laws are followed and send dangerous people who are not citizens out of the country. She also said that the Supreme Court's choice means the President can send away people who have broken the law and "Make America Safe Again."
Sotomayor wrote that the court's decision could put many people in danger of being hurt or killed. She said this was a win for the Trump administration, even though they had not followed a court rule before.
She wrote that the government has shown it does not follow the law. It thinks it can send people away without telling them or letting them speak. Justices Elena Kagan and Ketanji Brown Jackson agreed with her.
South Sudan is a very new and poor country. It became independent from Sudan in 2011. Since then, there has been a lot of fighting. Now, the political problems are getting worse, and this could start another war.
The Justice Department said in court papers that the government is thinking about the order to decide what to do next.
The highest court stopped a rule from April. This rule let immigrants say that being sent to another country would be dangerous for them. They could say this even if they had no more legal ways to stop it.
He saw that sending people to South Sudan in May was against his rule. So, he told the immigration workers to let people talk about these problems with their lawyers. The workers kept the people in a shipping container in Djibouti. It was a difficult place for everyone there, including the workers.
The government made agreements with countries like Panama and Costa Rica to keep immigrants there. This is because some countries do not want their own people back after they are sent away from the U.S. Sotomayor wrote that the people sent to South Sudan in May were told they had to leave very quickly, with less than 16 hours' notice.
Murphy, who President Joe Biden chose, said that people could still be sent to other countries. But he also said that people must have a chance to show they might be in serious danger if they are sent somewhere else.
In another case, the Trump government sent a gay man from Guatemala back to the U.S. He had been wrongly sent to Mexico, where he said he was hurt and robbed. He was the first person known to come back to the U.S. after being deported since Trump's second term started.
The judges had a similar problem. Trump wanted to send Venezuelans, who were thought to be gang members, to a well-known prison in El Salvador. They would not have a good chance to speak against this in court.
But in that case, the judges stopped people from being sent out of the country. They used an old law from the 1700s. They said that people who come to a new country must have enough time to ask a court for help before they are sent away.
The court, which has mostly conservative judges, has agreed with Trump in other immigration cases. This allowed his government to stop temporary legal help for almost a million immigrants.
