A former Meta engineering director testified Wednesday at a landmark trial that Instagram took a “don’t ask, don’t tell” approach to children under 13.
Arturo Béjar said Meta prioritized profits over safety.
He said the company focused on how often and how long people used its products, even if that hurt their mental well-being.
“If you step away from the product, they are not going to make any money,” he said.
The trial in federal court in Oakland, California, pits Meta against California, Colorado, Kentucky, and New Jersey.
These four states are among 29 that sued the tech giant in 2023 over child safety and privacy.
The lawsuit accuses Meta of knowingly designing features that addict children.
It also accuses the company of collecting data on kids under 13 without parental consent, which Meta denies.
Béjar worked at Facebook from 2009 to 2015 and returned as a contractor from 2019 to 2021.
He testified that employee reviews and pay were mostly tied to user numbers and time spent on products.
“In that context, safety was an afterthought,” he said.
He also said he found “tens of thousands” of kids under 13 on Instagram.
He added that it was “common knowledge” at the company.
Béjar described features designed for adults that are “inherently unsafe for teenagers,” including video autoplay and popularity counters.
He said a safety tool called “Take a Break,” introduced in 2021, was “designed to fail.”
He explained that users must turn it on and can dismiss it easily.
“A safety tool has to be on by default,” he said.
The states are seeking changes to user experiences and financial damages that could include billions of dollars.
