Later this month, the Supreme Court will determine whether to grant certiorari in a lobster fisherman's challenge to a governmental mandate requiring vessels to employ electronic tracking devices—a case whose ramifications could reverberate broadly throughout the American commercial fishing industry.

Maine lobsterman Frank Thompson has instituted federal litigation against the director of his state's marine resources department, contesting a mandate that he affix a GPS tracker to his vessel as a condition of retaining his fishing license.

In 2023, the state—where lobster fishing constitutes an industry both critical and historic—mandated that all federally permitted lobstermen do so in order to comply with a new U.S. rule aimed at data collection.

Thompson averred that the monitoring amounted to an unreasonable search and seizure, yet a federal appellate court rebuffed his claim last year.

He petitioned the Supreme Court, which is poised to review the claim on Sept. 28.

"The petition inquires as to whether Maine may compel lobstermen to bear government GPS trackers aboard their private vessels, even when they are off the job," said Matt Gilliam, Thompson's lead attorney.

"We are hopeful that the court will grant review and address this important Fourth Amendment question."

Numerous U.S. commercial fishermen are subjected to surveillance at sea—both by human observers and electronic apparatus—for the purpose of amassing data that regulators deem indispensable to sustaining the industry and fish populations in a healthy and viable state.

Over the years, fishing groups have resorted to litigation in an effort to circumscribe monitoring mandates, with equivocal outcomes.

Authorities have asserted that the lobster boat monitoring initiative is pivotal to enhancing comprehension of the valuable crustacean's population at a juncture when it appears to be waning in New England.

A spokesperson for the Maine Department of Marine Resources demurred from commenting on Monday.

Carl Wilson, the department’s commissioner, asserted last year that the data gleaned from lobster boats is indispensable to “mitigate economic harm to the industry” as well as to inform regulations.

Conservation organisations have inveighed against endeavours to curtail the monitoring of fishing vessels at sea, which they regard as indispensable to safeguarding the broader ocean.

“Endeavours to overturn a federal appeals court ruling do not alter the reality that New England’s lobster population has declined and that fishery managers urgently require reliable and detailed data in order to respond to the complex issues confronting our ocean,” said Erica Fuller, senior counsel with Conservation Law Foundation.

The U.S. lobster industry is concentrated predominantly in Maine, where fishermen harvested in excess of 78 million pounds (35.4 million kilograms) of the crustaceans last year.

That figure was commensurate with the industry's customary annual catch throughout the 2000s, yet it represents a precipitous decline relative to a decade prior, when catches routinely surpassed 120 million pounds (54.4 million kilograms) annually.
