Three news organisations that had been barred from the White House for several days returned on Thursday, after a judge granted CNN, MS NOW and Politico a stay in an extraordinary confrontation between President Donald Trump and the media outlets whose coverage he dislikes.

And yet, media coverage of the White House under Trump has been anything but conventional.

On a day of considerable fanfare, as Chinese leader Xi Jinping visited Washington and was slated to attend a state dinner, not a single major American television network carried live coverage.

After the White House excluded CNN from the rotation whereby America's five major broadcast networks take turns filming and sharing video footage, the remaining four, in a show of solidarity, continued to refuse to take part in the so-called video pool.

This was but one scene in a tumultuous day for the White House and the courts.

Initially, in the early hours of the morning, reporters from CNN, MS NOW, and Politico were turned away at the door.

A Secret Service agent confiscated their credentials, an act that formed part of the ban.

After a ruling was issued in the early hours of Thursday concerning the aforementioned outlets, White House operations officials were notified to reinstate access for the affected journalists, yet they indicated that it would take some time to retrieve, reactivate, and deliver their passes.

According to a government court filing, this process took more than two hours.

In a ruling that temporarily lifted the ban, U.S. District Judge Timothy Kelly ordered the White House to "immediately return, restore, and reinstate" the three outlets' access.

He declared that they had met the legal threshold for obtaining a temporary restraining order and were highly likely to succeed in proving that their press credentials had been revoked without due process.

The ruling did not address the matter of CNN's expulsion from the White House video pool.

The White House did not respond to an email seeking comment.

Kelly — whom Trump nominated in 2017 and who, in a similar case in 2018, ordered the restoration of a CNN correspondent's access — stated that the government must establish clear criteria defining what conduct warrants the revocation of a press pass.

He characterized the objectionable reporting standards outlined in the White House's letters to these outlets as "so vague as to be virtually unworkable."

The judge also made it unequivocally clear that he did not accept the government's contention that the reporting of these news organizations imperiled national security—noting that Trump himself had not initially invoked that argument, but had focused solely on what he characterized as negative coverage.

Theodore Boutrous Jr., counsel for these news organizations, asserted that the judge's expeditious ruling affirmed the principles of a free press, due process, and the rule of law.

"I am firmly convinced that we shall emerge from this ordeal all the stronger, and that the strategy of indiscriminately vilifying the press and singling out individual journalists will inevitably be abandoned," Boutrous remarked in an interview with MS NOW on Thursday afternoon.

"The law is unequivocally on our side," he stated.

The temporary restraining order — whose purpose is generally to preserve the status quo while the court subjects the case to more deliberate scrutiny — is set to expire in two weeks.

The judge gave both sides until October 5 to submit arguments on whether a more enduring preliminary injunction ought to be considered.

Kelly said he "intends to rule promptly" on the request for a preliminary injunction.

At the hearing, Boutrous argued that restoring access was a matter of utmost urgency, asserting that the ban had inflicted irreparable harm on these outlets at a time when momentous news events were unfolding.

"We are in a state of war," he told the judge.

"World leaders are arriving in Washington one after another."

During the argument, Michael Welchick, a Justice Department lawyer, reaffirmed the government's position that the president holds the prerogative to determine who may be granted access to the White House.

"Access to the White House is, in truth, a privilege rather than a right," Welchick remarked.

In arguing that Trump had not engaged in viewpoint discrimination—that is, singling out a particular media outlet on account of the content it articulates or the information it publishes—Welchick observed that although the president had criticized other news organizations, he had not imposed bans on them.

By way of illustration, he cited as evidence the instance in which Trump had called ABC "the worst."

After the Wednesday hearing drew to a close, the major television networks all refused to broadcast footage of Trump unless they received an unequivocal assurance that CNN would be permitted to rejoin the video pool.

At Joint Base Andrews — where the President formally welcomed Xi Jinping — although correspondents from Fox News, CBS, and NBC were all present, they did not conduct any video filming.

Judging by the markings on tripods and cameras, the other television outlets with reporting teams on site included NewsNation, Newsmax, Right Side Broadcasting Network, One America News, and LindellTV.

The reporter claimed that he had furnished clients with video footage of Trump welcoming Xi Jinping, leaving it to them to exercise their own discretion as to whether it should be broadcast.

"We did not carry live coverage on our own platforms—including APNews.com or our YouTube channel," said Patrick Maks, a spokesperson for the Associated Press.

In an advisory to its clients, the Associated Press stated that it would not have the right to independent video coverage of the meeting between Trump and Xi, and noted that the live feed provided by the U.S. government could be accessed via the White House website.

The journalists are among roughly 50 groups that filed amicus briefs on the eve of Wednesday's hearing, urging the court to immediately restore the three outlets' White House access.
