Une cour d'appel fédérale va probablement confirmer la décision de l'ancien président Donald Trump de garder le contrôle des troupes de la Garde nationale de Californie. Ces troupes avaient été envoyées à Los Angeles après des manifestations liées à des opérations contre l'immigration. Cette décision fait suite à un jugement d'un tribunal inférieur qui avait demandé à Trump de rendre le contrôle de la Garde au gouverneur démocrate Gavin Newsom. Le gouverneur n'était pas d'accord avec ce déploiement et pensait que Trump avait dépassé ses pouvoirs. Le résultat de cette affaire pourrait avoir de grandes conséquences sur le droit du président d'envoyer des soldats dans les villes américaines. Il faut savoir que c'est la première fois depuis 1965 qu'un président utilise la Garde nationale d'un État sans l'accord de son gouverneur. Les juges, dont deux ont été choisis par Trump et un par Biden, ont dit que les présidents ont beaucoup de liberté selon la loi fédérale concernée. Cependant, ils n'ont pas accepté l'idée de l'avocat du ministère de la Justice selon laquelle les tribunaux ne pourraient pas revoir la décision de Trump. La décision finale de ce groupe de juges est attendue bientôt.
