An Immigration and Customs Enforcement officer charged with shooting a man in Minneapolis was released from a Texas jail on Thursday.

The release happened after a judge refused to order his return to Minnesota.

Christian Castro left a detention center in Brownsville at dawn and drove off in an SUV.

Castro faces charges in Minnesota for assault and falsely reporting a crime.

He is accused of firing through a front door on Jan. 14 and shooting 24-year-old Julio Cesar Sosa-Celis in the leg.

Prosecutors say Castro also falsely claimed that Sosa-Celis and another man attacked an ICE officer.

Minnesota authorities arrested Castro on May 29 and have sought his extradition since then.

Under Texas law, he had to be released after 90 days of detention unless he was extradited.

U.S. District Judge Fernando Rodriguez Jr. ruled that the case was not ready for court action.

He said Minnesota could not prove that Texas Gov. Greg Abbott had already violated extradition laws.

Minnesota Attorney General Keith Ellison accused Abbott of turning Texas into a sanctuary state for violent criminals.

Abbott responded by calling Minnesota lawyers unprepared and uninformed.

Minnesota officials say Castro could flee to Mexico, citing his jail calls to a woman there about buying a house.

The judge acknowledged the risk but said the threat alone did not justify court intervention.
