In its preliminary findings, the European Commission posited that TikTok's advertising repository failed to meet the requisite benchmarks stipulated by the Digital Services Act (DSA), a deficiency potentially indicative of systemic non-compliance with the legislative framework.

委員會申明，廣告數據庫於研究群體而言，其重要性不言而喻，蓋因此數據庫不僅能輔助偵測詐欺性廣告，更能有效辨識混合式威脅行動、協同性資訊戰，以及虛假廣告——尤其是在選舉語境下，此等偵測能力更顯關鍵。

數位服務法 (DSA) 是一部旨在全面規範社群媒體平台之法典，其目的在於保障使用者免受諸多風險之侵害，包括選舉相關之不實資訊；平台有義務確保數位廣告之透明度，具體而言，必須向使用者揭露廣告投放之緣由以及贊助者之身份。

The committee asserted that TikTok's opacity regarding advertisement provenance, target demographics, and pecuniary sponsors, compounded by the database's inability to facilitate comprehensive interrogation thereof, "severely curtails the instrument's efficacy," the committee elaborated.

歐盟委員會科技主權、安全與民主事務執行副主席 Henna Virkkunen 聲稱，由於該廣告資料庫存在結構性缺陷，致使其廣告定向系統所衍生的潛在風險，實際上無法進行一次周延詳盡的風險評估。

Virkkunen 強調：「線上廣告透明化的必要性——涵蓋出資者身分及受眾定向邏輯——實為維護公共福祉之基石。無論是為確保民主選舉之公正無瑕、捍衛公共衛生之健全抑或杜絕消費者遭受欺詐性廣告之侵害，公眾皆有權知悉資訊傳播背後之實體。」

Pending the committee's definitive adjudication, TikTok is now afforded an opportunity to offer a rejoinder, the potential ramifications of which could entail a pecuniary sanction of up to 6% of its consolidated annual global revenue.

TikTok 亦正接受歐盟另案調查之嚴格審查，其焦點在於該公司是否未能充分且有效地應對羅馬尼亞總統大選所涉風險，蓋因該選舉去年飽受選舉舞弊及俄羅斯干預之指控，致使局勢陷入泥淖，社會信任蕩然無存。
