On Thursday, European Union regulators excoriated TikTok for contravening the Digital Services Act, citing a lack of sufficient transparency regarding advertisements displayed to users of the video-sharing application, thereby jeopardizing regulatory compliance.
In its preliminary findings, the EU's executive body asserted that TikTok's advertising repository fails to meet the requisite benchmarks stipulated by the Digital Services Act (DSA), applicable across the 27-nation bloc, thereby initiating further scrutiny into potential systemic non-compliance.
The committee explicated that the advertising database is mission-critical for researchers in detecting fraudulent advertisements, so-called hybrid threat campaigns, coordinated information operations, and deceptive promotional material, further stipulating its relevance "even within the context of electoral processes."
Encompassing a vast array of stipulations, the Digital Services Act (DSA) seeks to effectuate a remediation of social media platforms and safeguard users from exigencies such as election-related disinformation; platforms are thereby obligated to ensure transparency concerning digital advertising, including elucidating the rationale behind the presentation of specific advertisements and identifying the entities responsible for defraying associated costs.
The committee asserted that TikTok's failure to furnish requisite data pertaining to advertisement content, targeted demographics, and funding origins, coupled with a database architecture that precludes comprehensive, data-driven advertisement searches, fundamentally compromises the tool's utility.
TikTok has affirmed that it is currently scrutinising the committee's findings and remains committed to fulfilling its obligations under the Digital Services Act.
In their statement, the company affirmed their commitment to the regulatory objectives and ongoing refinement of instruments designed to enhance advertising transparency, while simultaneously registering their dissent with specific interpretations advanced by certain committee members, further noting that the guidance in question lacked the formal status of publicly ratified directives, being instead conveyed via preliminary investigative findings.
Hanna Virkkunen, the European Commission's Vice-President for Technology Sovereignty, Security, and Democracy, asserted that lacunae within the advertising database critically impede a "holistic verification" of the systemic risks engendered by advertising targeting mechanisms.
"Vilhunen asserted that transparency in online advertising – encompassing the pecuniary beneficiaries and audience targeting methodologies – is paramount to safeguarding the public interest, underscoring that citizens possess an inalienable right to know the provenance of the messages they encounter, be it to preserve the integrity of democratic elections, protect public health, or shield consumers from fraudulent enticements."
TikTok is afforded the opportunity to present its observations prior to the committee's conclusive determination, a decision which could potentially engender a fine of up to 6% of the company's annual global turnover.
Furthermore, TikTok is also the subject of a separate EU investigation concerning its alleged failure to mitigate risks pertaining to the tumultuous aftermath of last year's Romanian presidential election, marred by allegations of electoral malpractice and suspected Russian interference.
