Attorneys handling the $2.78 billion NCAA settlement case suggested on Wednesday a big change to how many players can be on a team. This change is meant to get back the spots lost after the settlement was finished. It would let players play as long as they are allowed to, without counting towards a new limit.
In either scenario, these athletes will not count towards the new roster limitations, which were unveiled last autumn and received initial endorsement from US District Judge Claudia Wilken last October.
This proposal also extends to high school freshmen who had a previously promised position later withdrawn, with the provision remaining in effect as long as the athletes maintain eligibility in college.
Judge Wilken has already approved important parts of the agreement. This agreement says that each school can pay athletes up to $20.5 million directly each year. It also includes over $2.7 billion in back pay for the players. This is because the judge said the NCAA and the five main conferences unfairly stopped players from making money from their name, picture, and likeness.
The latest proposal marked the culmination of two weeks of turmoil, as Judge Wilken directed counsel for both parties to return to the negotiating table. The judge stated that the specifics of the roster restrictions outlined in the initial plan were unacceptable.
This proposal mandates the substitution of scholarship limits, for example, 85 slots in football and 9.9 in men's wrestling, with roster limits, such as 105 players in football and 30 in wrestling. While universities could technically provide scholarships to all team members, this would be significantly more expensive, likely leaving walk-ons and partial scholarship athletes without funding.
Judge Wilken showed evident sympathy for the hundreds of players who lost roster spots while preparing to implement settlement terms, with approximately twelve individuals testifying about their experiences at the April 7th hearing.
The lawyer for the plaintiff also said that the players who were removed could come back without being counted in the new team size limit. They also said these players might get the same special permission at other schools.
According to their court filings, the plaintiffs contend that these modifications to the settlement agreements go beyond the protective measures stipulated by the court.
Nonetheless, legal experts have pointed out that there is no guarantee that the athletes will necessarily regain their roster spots.
The defendants wanted to change the agreement to show that each school and its track team can always choose which athletes are on their team list, and this is true even with team list limits. This change to the agreement makes sure that team members who lost their spot or a promised spot because of the new team list limits are treated as if the limits were not there. This means the team list limits do not apply to them.
For the NCAA, its 1,200 member institutions, and the over 500,000 athletes across various teams at each school, time is rapidly running out. The terms of the settlement are slated to take effect on July 1st, with football practices scheduled to commence shortly thereafter.
