A federal appellate court appears poised to uphold former President Donald Trump's authority over the California National Guard troops, initially deployed in response to Los Angeles demonstrations stemming from immigration raids, notwithstanding a district court ruling that mandated the return of command to Democratic Governor Gavin Newsom, who contested the deployment as an overreach of presidential prerogative. The ramifications of this legal challenge extend to the very core of presidential power regarding troop deployments within U.S. municipalities, marking the first instance since 1965 of a presidential activation of a state's National Guard absent gubernatorial consent; whilst the judicial panel, comprised of two Trump appointees and one Biden appointee, intimated a broad interpretation of presidential latitude under the relevant federal statutes, they nevertheless demurred from the Department of Justice's assertion that the judiciary lacked the capacity to adjudicate Trump's decision, and a pronouncement from the appellate body is anticipated imminently.
