Ein Gericht hat vorläufig entschieden, dass Präsident Trump die Kontrolle über die Nationalgarde in Kalifornien nicht sofort an den Staat zurückgeben muss. Die Nationalgarde war in Los Angeles eingesetzt worden, weil es dort Proteste wegen Einwanderungskontrollen gab.

Ein US-Richter namens Charles Breyer hatte zuvor entschieden, dass der Einsatz des Militärs nicht erlaubt ist, weil er gegen einen wichtigen Teil der Verfassung verstößt und Trumps Macht überschreitet. Der Gouverneur von Kalifornien, Gavin Newsom, fand diese Entscheidung gut.

Das Weiße Haus kritisierte Breyers Anordnung als „einmalig“ und „Machtmissbrauch“. Die Entscheidung betraf nur die Nationalgarde, aber nicht die Marines, die auch im Einsatz waren. Newsom hatte den Einsatz der Garde vor Gericht angefochten, weil er meinte, dass dies die Spannungen erhöhen und zivile Unruhen fördern würde.

Der Einsatz erfolgte gemäß Titel 10. Dieser erlaubt dem Präsidenten, die Nationalgarde unter bestimmten Umständen für den Bundesdienst einzusetzen.
