In its preliminary investigative report, the European Commission, acting as the executive arm of the 27-member bloc, posited that TikTok's advertising repository demonstrably failed to meet the benchmarks stipulated by the Digital Services Act (DSA).

The commission posited that the advertising repository is of paramount importance to researchers for the identification of mendacious advertisements and so-called hybrid threat campaigns, coordinated disinformation operations, and fraudulent advertising, particularly within the exigent context of electoral cycles.

The Digital Services Act, a sweeping regulatory framework, aims to sanitise social media platforms and safeguard users from a spectrum of risks, encompassing election-related disinformation. Platforms are compelled to maintain transparency in digital advertising, necessitating the disclosure to users of the rationale behind their exposure to specific advertisements and the identification of the associated financial backers.

The committee posited that TikTok's dereliction in furnishing indispensable particulars pertaining to advertising content, targeted demographics, and the ultimate beneficial owners remitting payment for said advertisements, coupled with the demonstrable impediment to comprehensively interrogate its advertising repository based on the aforementioned datasets, substantively vitiates the instrument's functional efficacy.

Furthermore, TikTok is contending with a separate EU investigation, the purpose of which is to ascertain whether it adequately mitigated the risks stemming from alleged electoral irregularities and purported Russian interference during the Romanian presidential election of the preceding year.
