A man from Venezuela was shot by a U.S. ICE officer.

His lawyer said he was back in the hospital by Monday night.

Wilber Rafael Garces Perez is 28 years old.

He was taken to a detention center in Texas.

A bullet is still in his back.

Perez was working for DoorDash in Austin on Sunday.

He was making a delivery.

Then ICE officers in a truck with no marks hit his car two times.

His lawyer is Kate Lincoln-Goldfinch.

She said the officers hit his car and shot him in the back of the neck.

He was trying to park.

He was treated at a hospital.

But later on Sunday, he was released into ICE custody.

The bullet was still inside him.

Perez spoke by phone on Monday.

He said doctors did not take out the bullet.

It is near his spine.

He said ICE wanted to move him fast to a detention center.

He said he got no pain medicine there.

He slept on the floor.

Then a nurse gave him a pill.

Lincoln-Goldfinch said Perez was held at the South Texas ICE Processing Center in Pearsall.

It is about 130 miles southwest of Austin.

She said he told her he was being questioned.

The Department of Homeland Security said it is looking into the shooting.

The man is from Venezuela and was in the U.S. illegally.

He had a final order of removal.

The department has not said what caused the shooting.

Lincoln-Goldfinch said Perez came into the U.S. legally in 2024.

He used the CBP One program.

He had a valid work permit.

She said a judge ordered his deportation.

He missed a hearing because the notice went to an old address.

U.S. Rep. Greg Casar said the hospital return is a good first step.

Local advocates and Democratic lawmakers want an independent review of ICE use-of-force incidents.

They also urged Congress to ban ICE traffic stops.
