A judge in Utah will decide on Tuesday whether Tyler Robinson will go to trial.

Robinson is accused of killing Charlie Kirk.

The charge is aggravated murder.

If he is found guilty of this charge, he could get the death penalty.

In July, prosecutors spent five days in court.

They said they had "overwhelming" evidence against Robinson.

He is 23 years old.

Robinson gave himself to the police one day after the shooting.

The shooting happened at Utah Valley University last September.

He has not said if he is guilty or not guilty.

His lawyers want to stop the trial.

They also want to remove the death penalty option.

There was heavy security around the courthouse in Provo.

Kirk's parents arrived holding arms together.

The judge could send the case to trial on a lesser murder charge.

That charge means 15 years to life in prison.

He could also drop the charges.

Then prosecutors could file them again.

A big question is if the shooting put other people in danger.

Defense lawyers said the shooter "hit the intended target."

But prosecutors said many people were in a "zone of danger" around Kirk.

Prosecutors also say Robinson chose Kirk because of his political beliefs.

They show a bullet with words on it.

The words say "Hey Facist! CATCH!"

They also show a note.

The note says, "I had the opportunity to take out Charlie Kirk, and I took it."

Robinson's lawyers say the proof of political reasons is weak.

They also questioned DNA tests.

The tests link Robinson to the rifle.

The judge will say his decision from the bench on Tuesday.

He will do this after final arguments.
