A judge in Utah will decide on Tuesday whether Tyler Robinson will go to trial for aggravated murder in the death of Charlie Kirk.

If he is found guilty of that charge, Robinson could face the death penalty.

Prosecutors spent five days in July presenting what they called "overwhelming" evidence against the 23-year-old defendant.

Robinson turned himself in one day after the shooting at Utah Valley University last September.

He has not entered a plea yet.

His lawyers have tried to stop the trial and remove the death penalty option.

There was heavy security around the courthouse in Provo, where Kirk's parents arrived arm in arm.

The judge could send the case to trial on a lesser murder charge, which means 15 years to life in prison.

He could also dismiss the charges, which would let prosecutors file them again.

A key point is whether the shooting put other people in danger.

Defense lawyers said the shooter "hit the intended target," but prosecutors said many people were in a "zone of danger" around Kirk.

Prosecutors also say Robinson chose Kirk because of his political beliefs.

They point to a bullet with the words "Hey Facist! CATCH!" and a note that said, "I had the opportunity to take out Charlie Kirk, and I took it."

Robinson's lawyers say the proof of political motivation is not strong.

They also questioned DNA tests that linked Robinson to the rifle.

The judge plans to give his decision from the bench after final arguments on Tuesday.
