A group of 26 Meta employees has sued the company.
They accuse Meta of using an AI system to choose who to fire.
This system unfairly targets employees on medical, parental, or family leave.
These employees are part of the 8,000 job cuts Meta announced in May. That is about 10% of its workforce.
The lawsuit was filed on Monday evening in federal court in Oakland, California.
The lawsuit says the company used an internal AI system to decide who to fire. It also used data on keystrokes and activity, an AI token usage dashboard, and algorithm-assisted performance scores.
The lawsuit says these scores and ratings "are designed so that employees on protected medical or family leave cannot get them. Employees whose work is reduced because of a disability also cannot get them."
Meta did not consider protected leave when looking at the scores.
Meta
The company also did not stop the system to do the individual reviews required by law.
As a result, employees on protected leave were chosen at a higher rate.
All 26 anonymous plaintiffs had taken protected leave or asked for reasonable accommodations.
They have received layoff notices, but their departures will start on July 22.
About half of the plaintiffs took leave for caregiving or pregnancy reasons.
This includes 8 women on maternity leave, 4 men on paternity leave, and 1 woman on family care and bereavement leave.
The lawsuit says the layoffs broke many state and federal laws. These include the Family and Medical Leave Act and the Americans with Disabilities Act.
The complaint also uses "disparate impact liability." This is a civil rights idea. It says a neutral policy may be discriminatory. It unfairly hurts a protected group of workers. It is not needed for the job.
The plaintiff's lawyers argue that Meta's "algorithm-assisted selection process" affects women more. It does this by systematically recording absences as lower performance.
This is because women take pregnancy leave and care leave more often.
Meta said in a statement that these claims "lack legal basis and are not based on facts."
The company stressed that humans, not AI, make workforce management decisions.
The plaintiff's lawyers said the lawsuit only asks to keep the current situation until arbitration.
This is because once the layoff is final, the damage will be irreversible. It includes losing health insurance, losing leave rights, and immigration consequences.
