The construction of any large-scale data centers in New York has been prohibited for a period of up to one year, as the state formulates regulatory frameworks intended to safeguard both the environment and its energy infrastructure from the exorbitant power demands of the facilities that underpin artificial intelligence.
Governor Kathy Hochul has issued an executive order instituting the nation’s first statewide moratorium on hyperscale data centers—facilities housing thousands of computer servers that demand prodigious energy consumption and a constant water supply for cooling purposes.
This development thrusts the state into a contentious deliberation over the governance of the artificial intelligence sector, where mounting anxieties regarding escalating electricity costs and environmental repercussions are juxtaposed against the imperative to invigorate local economies and bolster the United States' technological industry.
“The fundamental imperative is that advancement must not be concomitant with exorbitant utility costs, the cessation of water provision, or acoustic degradation; consequently, we are compelled to confront the exigencies engendered by these colossal installations,” Hochul declared during a celebratory signing ceremony in Brooklyn.
President Donald Trump has cautioned states against imposing regulatory frameworks on the artificial intelligence sector, aligning with technology firms in contending that such measures impede employment expansion and forfeit strategic advantage to China in the contest for supremacy within this swiftly evolving domain.
Earlier this year, Maine appeared on the verge of enacting a comparable moratorium; however, the measure was vetoed by Democratic Governor Janet Mills, as it would have precluded the construction of a proposed data center in a municipality that has experienced economic hardship following the closure of a mill.
Moratoriums have been proposed in at least a dozen states but have failed to gain significant traction, although certain counties and municipalities have enacted their own temporary prohibitions.
The governor’s office announced that New York’s executive order suspends state permitting for new large-scale data centers and mandates that state regulators develop standards addressing environmental impacts, energy consumption, water usage, and other pertinent considerations.
Dan Diorio of the Data Center Coalition, a trade association, asserted that the moratorium “will ensure that those investments, jobs, and economic activity flow elsewhere rather than to New York — with impacts far beyond the data center industry.”
The decision in New York also carries profound political implications for Governor Hochul’s reelection campaign and the state’s fiercely contested congressional races this autumn, as Democrats endeavour to assuage concerns over exorbitant utility bills and the escalating cost of living.
Moreover, the governor has this year tempered New York’s ambitious greenhouse gas reduction targets, citing the burden of rising energy costs on consumers.
Hochul’s Republican adversary in the gubernatorial contest, Nassau County Executive Bruce Blakeman, opposes a statewide moratorium and contends that local governments ought to be permitted to negotiate agreements with technology firms for data centre projects that promise sufficient economic advantages.
In a statement issued on Tuesday, Blakeman asserted that the governor “doesn’t work with local governments and business leaders to figure out how to get things done,” while simultaneously vowing to “modernize our economy to bring costs down and create good jobs.”
The state Legislature this year ratified its own moratorium bill, yet Hochul’s office characterized the legislation as intricate and asserted that it required further refinement.
Consequently, the governor opted for an executive order, which would take immediate effect.
State Senator Kristen Gonzalez, a Democrat who sponsored the legislation, stood alongside the governor during the signing ceremony.
“If Big Tech encroaches upon our domain, it must do so on our own terms,” she asserted.
New York, at this juncture, has yet to emerge as a nexus for the most expansive hyperscale data centers.
